These terms apply to access to CloudSend, a software service for business WhatsApp campaigns and customer messaging. By accessing or using the service, you agree to these terms on behalf of yourself or the business you represent. If you do not agree, do not use the service. The operator's legal identity and governing jurisdiction must be supplied by the operator before production publication; this page does not invent them or provide legal advice.
Accounts and access
Account registration is currently open. You must provide accurate account information, protect your credentials and notify the operator if you believe your account has been accessed without authorization. The operator may restrict or suspend access as described below. You are responsible for activity performed through your account.
Customer responsibilities and messaging
You are responsible for the business, contacts, content, templates and campaigns you submit; for having the permissions and legal basis required to message each recipient; for honoring opt-outs; and for following applicable laws and WhatsApp/Meta terms and policies. Do not use CloudSend to send unlawful, misleading, unsolicited or otherwise unauthorized messages. A suppression list is a product safeguard and not a legal-compliance guarantee.
Campaigns are for multiple recipients and use approved WhatsApp templates as required by the integration and Meta policies. Quick Message supports one-to-one messaging. You are responsible for reviewing recipients, message content, personalization and schedules before sending. Sending and delivery depend on the connected account, Meta/WhatsApp, recipient availability, permissions and technical conditions. CloudSend does not guarantee delivery, reading, response, sales or uninterrupted availability.
Contacts, templates and suppression
You retain responsibility for the contacts and data you upload and warrant that you may use them for the intended purpose. You must use eligible templates and comply with Meta's review and messaging requirements. You must promptly honor opt-out requests. Removing a suppression entry should only occur after you have confirmed that future messaging is appropriate.
Agent Auto Reply
If enabled, Agent Auto Reply may process incoming customer messages through the AI provider configured by the operator. Generated content may be inaccurate, incomplete or inappropriate. You are responsible for deciding whether to enable the feature, setting appropriate expectations, reviewing its operation and ensuring its use is appropriate for your business.
Third-party services
CloudSend integrates with third-party services, including Meta/WhatsApp and the configured PostgreSQL hosting provider; an AI provider may be used when auto replies are enabled and configured. Those services are subject to their own terms, availability and policies. CloudSend does not control third-party services.
Plans and manual payment
Plan names, prices, currencies, durations and included features are configured by the CloudSend operator and shown in the service when available. Payment is made by the transfer methods configured by the operator, outside a payment gateway. If you submit a plan request, it remains pending until an administrator verifies the payment and approves or rejects it. A subscription begins only after approval; an approved renewal may begin after an existing active term expires. The plan's features may be restricted when it expires or as described by its entitlements. Customers share payment-receipt screenshots directly with the configured WhatsApp Business number and must attach them manually. Meta/WhatsApp may separately charge usage fees under its current pricing and billing terms.
Acceptable use; suspension and termination
You must comply with the Acceptable Use Policy. The operator may restrict or suspend access where reasonably necessary to protect users, the service, third parties or comply with applicable requirements. You may stop using CloudSend and ask the operator about account closure and data deletion. Closing access does not itself erase retained records or backup copies.
Intellectual property
CloudSend and its original software, branding and materials belong to their respective owners. You receive only a limited, revocable right to use the service as made available. You retain responsibility for content and data you submit and must have rights to use them. Meta and WhatsApp names and marks belong to their respective owners.
Disclaimers
To the extent permitted by applicable law, CloudSend is provided on an “as available” basis. The operator does not warrant error-free operation, uninterrupted availability, message delivery or results, or that generated replies are accurate. Nothing in these terms excludes a right or liability that cannot legally be excluded.
Limitation of liability
To the extent permitted by applicable law, the operator is not liable for indirect, incidental, special or consequential loss, including lost profits, data or business opportunity, arising from use of the service or third-party messaging services. Any legally applicable limits, exceptions and governing rules require review and completion by qualified counsel for the operator's jurisdiction.
Governing law
Not configured. Before production use, the operator must insert the governing country/region and courts or dispute forum that apply to its legal entity, after qualified legal review. No jurisdiction is asserted by this draft.
Changes and contact
The operator may update these terms as the service changes. Continued use after an update constitutes acceptance where permitted by applicable law. For questions, contact the person or administrator who provided your CloudSend access. The operator must add verified business contact and governing-law details before relying on these terms as final legal terms.
